A basical book in this area, very useful not only for jewish person who wants to plan his estate according talmudical rules, but also for non jewish people, who wants to know the rudiments of the jewish law about the inheritance. Very clear. To judge in a correct way this review, I have to say I'm a non jewish italian civil law notary who's studying an historical case involving conflict of laws and jewish law of inheritance.

This book argues that the traditional Jewish law of inheritance overrides secular law, based on rabbinical writings from the 15th-19th centuries. I don't know enough to agree or disagree with Grunfeld (though he admits that Moshe Feinstein, the leading American 20th c. halakhist, seems to take a more lenient view).

Grunfeld's general instincts seem to be very traditionalist indeed; for example, he suggests that the Torah's rule favoring sons over daughters is simply a Divine decree with no obvious justification. (I doubt this is the case; in a tribal, agricultural society there may have been some rational, secular basis for these reasons that we simply don't know about it.) He also writes that the ambiguities of the written Torah show that "the Oral Law preceded the Written Law"- which makes me wonder why the Oral Law (that is, the Mishnah and Talmud) also has ambiguities. He also goes on and on about how the laws of inheritance are "fundamental"- which makes me wonder if there is some part of the Torah that is NOT fundamental.

For anyone interested in the Jewish law of inheritance and its relation to the general laws of inheritance, this book is invaluable. Dayan Grunfeld, the late member of the London Beth Din (Jewish Court), has written a systematic analysis of the topic. He explains the Jewish law of inheritance, whether it can be overruled by the laws of the land, and methods by which one can leave property to heirs not specified in Jewish law. He also has an interesting chapter on the general relationship in Judaism between the law of the land and religious law.
